3.1 Account Creation

To use Scribbin, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.2 Account Security

You must notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or illegal activities.

4. User Content and Intellectual Property

4.1 Your Content

You retain ownership of all text, images, and other content you provide to Scribbin ("User Content"). By using the Service, you grant Scribbin a non-exclusive, worldwide, royalty-free license to use, store, display, reproduce, and distribute your User Content solely for the purpose of providing and improving the Service.

4.2 AI-Generated Content

Content generated by AI (stories and illustrations) is created based on your prompts and inputs. While you may use this content for personal, non-commercial purposes, you acknowledge that:

• AI-generated content may not be eligible for copyright protection in all jurisdictions
• Similar content may be generated for other users based on similar prompts
• You are responsible for ensuring your use of AI-generated content complies with applicable laws

4.3 Prohibited Content

You may not use Scribbin to create or distribute content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Contains explicit, violent, or age-inappropriate material for children
• Infringes upon the intellectual property rights of others
• Promotes hate speech, discrimination, or violence
• Contains personal information about minors without proper consent

5. Payments and Story Tokens

5.1 Story Tokens

Scribbin operates on a token-based system called "Story Tokens." Creating stories, generating images, and using certain features requires Story Tokens, which can be purchased through our platform.

5.2 Pricing

Current pricing for Story Tokens and services is displayed on our website. We reserve the right to modify pricing with reasonable notice. Price changes will not affect tokens already purchased.

5.3 Payment Processing

Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service and authorize us to charge your payment method for the amount due.

5.4 Auto-Replenishment

If you enable auto-replenishment, we will automatically purchase Story Tokens when your balance falls below your specified threshold. You may disable this feature at any time in your account settings.

6. Third-Party Services

6.1 Print Services

Print-on-demand services are provided by third-party vendors (including Prodigi). By ordering printed books, you acknowledge that:

• Scribbin is not responsible for printing quality, shipping delays, or delivery issues
• Print orders are subject to the third-party provider's terms and policies
• Custom printed books may not be returnable except for defects

Our AI story generation and image creation features use advanced AI technology. By using these features, you acknowledge that:

• AI-generated content quality may vary
• Generation requests may occasionally fail or produce unexpected results
• Content is filtered for appropriateness but is not perfect

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated means (bots, scripts) to access the Service without permission
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell, redistribute, or commercialize the Service or AI-generated content
• Impersonate any person or entity or misrepresent your affiliation

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SCRIBBIN DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, reliability, or quality of AI-generated content
• Warranties that defects will be corrected or that the Service is free of viruses

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCRIBBIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM:

• Your use or inability to use the Service
• Any AI-generated content or errors in such content
• Unauthorized access to your account or data
• Third-party content, products, or services

IN NO EVENT SHALL SCRIBBIN'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO SCRIBBIN IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Your legal rights. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot legally be limited or excluded. If you are a consumer, you have rights under the law (including, in the UK, the Consumer Rights Act 2015) that these Terms do not affect. The limitations above apply only to the extent the law allows.

You agree to indemnify, defend, and hold harmless Scribbin and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your User Content or any AI-generated content created through your account
• Your violation of these Terms or applicable laws
• Your violation of any third-party rights

Scribbin is intended for use by adults creating content for children. We do not knowingly collect personal information from children under 13. If you believe a child has provided us with personal information, please contact us immediately.

14. Termination

You may terminate your account at any time through your account settings. Upon termination, you will lose access to your account and any unused Story Tokens (which are non-refundable).

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms or engage in conduct that we determine is harmful to other users, us, or third parties.

15. Governing Law and Disputes

15.1 Governing Law

These Terms, and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims), are governed by and interpreted in accordance with the laws of England and Wales.

15.2 Jurisdiction

The courts of England and Wales have jurisdiction over any dispute arising out of or in connection with these Terms. If you are a consumer, this does not take away any protection you have under the mandatory laws of the country where you live, and you may also be able to bring proceedings in your local courts.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Scribbin.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Failure to enforce any provision of these Terms does not waive our right to enforce it later.

16.4 Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms without restriction.
